Коллекшн это что такое
Коллекторские агентства (или долговые агентства) — организации, чьей специализацией и является оказание услуг коллекшн, то есть взыскание просроченной дебиторской задолженности с физических и юридических лиц в пользу заказчика. В этом случае, коллекшн нужно понимать как бизнес. Коллекшн для коллекторских агентств — это основной вид деятельности, услуга, которую они оказывают.
Как в любом деле, сама организация деятельности по взысканию долгов нуждается в повышении эффективности и может стать предметом изучения. Это тоже услуги, но они предназначены для тех компаний, которые хотят организовать коллекторский отдел, либо повысить уровень работы своих сотрудников из такого отдела. Сюда относятся различные тренинги, курсы, консультации. Это коллекшн для бизнеса.
Конкретные законные действия по взысканию долгов — это обзвон должников, переговорная работа, возврат долга в судебном порядке, обращение в арбитражный суд, если речь идет о должнике — юридическом лице. Возникает резонный вопрос: почему всеми задачами, связанными с взысканием задолженности через суд, не может заниматься грамотный юрист?
Но в таком случае речь идет о юридическом сопровождении.
Что касается коллекшн — это более специализированный вид деятельности. Коллекшн включает в себя не только юридические инструменты, но и психологические приемы, позволяющие вернуть долги в досудебном порядке. Грамотный специалист, владеющий тонкостями такого предмета, как психология переговоров по телефону, способен вернуть большую часть долгов на начальном этапе взаимодействия с должниками, что позволяет не прибегать к обращению в суд. Навыками эффективной работы с проблемными клиентами могут обладать люди многих специальностей, например, продавцы-консультанты, менеджеры по продажам или адвокаты, но только для коллекторов это становится основным занятием.
Этапы работы коллекторских агентств в упрощенном виде можно представить так:
Договорной этап, осуществляется на дистанции. Soft-collection (англ. soft — мягкий) — на этом этапе проводится обзвон должников, выясняется причина невозврата долга, подтверждает ли заемщик наличие долга, возможность погашения, сроки погашения. Если по каким-то причинам выплата долга невозможно, с согласия заказчика вполне возможна, реструктуризация долга или дисконт.
Hard-collection (от англ. hard — суровый) предполагает личное общение с должником. В любом отделе продаж знают, насколько личная продажа эффективнее продажи по телефону. В коллекторском деле ситуация аналогична. Если два предыдущих этапа не дали результатов, самое время обратиться к помощи закона.
На этапе Legal collection (англ. legal — законный) агентство передает дело в суд и осуществляет сопровождение процесса, то есть берет на себя все работы, связанные с отстаиванием интересов клиента в суде: инициирует иск, контролирует ход процесса, отслеживает документацию.
